Should the Society wish to make submissions respecting costs, such submissions may be made in writing and filed with the Tribunals Office not later than 15 days after the date that this decision is forwarded to the parties, with a copy of such submissions being delivered to the Paralegal Applicant within the same time frame. The Paralegal Applicant's submissions in response are to be served and filed within 10 days after delivery to him of the Society's submissions. In the absence of submissions by the Society as above permitted, this Panel makes no order as to costs.

  3. A new hearing before a different Hearing Panel is hereby ordered. The matter is to be expedited.
  4. The Appellant shall have 10 days from today to file submissions as to costs.

Claude Hyman Armstrong, of the City of Mississauga. By Oral Motion heard on July 5,  2010, the paralegal applicant asked for an order extending the stay of the Decision and Order under appeal.

By Order dated July 5, 2010 the Appeal Panel ordered as follows:

  1. The candidate will be allowed to continue practising under the terms of Mr. Ruby's order until the decision of this Panel is released.

Claude Hyman Armstrong, of the City of Mississauga. By Notice of Motion dated March 3, 2010, the paralegal applicant asked for a stay of the Decision and Order of the Hearing Panel dated December 23, 2009, which dismissed the application for a P1 licence.

By Order dated March 26, 2010 the Appeal Panel ordered as follows:

  1. The Stay pending appeal is granted on the following terms:
    1. That the stay is to be in effect until the earlier of 90 days from this order or the hearing of the appeal; and
    2. That the Appellant shall be employed as a paralegal solely for Traffic Ticket People.
  2. The appeal in this matter shall be expedited.
  3. There is no order as to costs.

UNDER APPEAL
Claude Hyman Armstrong, of the City of Mississauga, a paralegal applicant, applied for a Class P1 licence.

By Decision and Order dated December 23, 2009, the Hearing Panel ordered as follows:

  1. The application for a P1 licence is dismissed.
  2. The Law Society may make written submissions with respect to costs within 21 days of the release of the Decision and Order in this matter.  The Paralegal Applicant may respond with submissions in writing 14 days following the receipt of the Law Society's written submissions.

By Order dated March 25, 2009, the Hearing Panel ordered as follows:

  1. The Paralegal Applicant shall within 30 days of the receipt of this Order advise the Law Society in writing whether he wishes to tender further evidence, solely on the issue of his present good character.
  2. If he indicates within that period that he wishes to do so, an early date will be arranged for this Panel (who remain seized with the matter), to reassemble, and hear that evidence, and any further submissions arising from the further evidence.
  3. In the event that he chooses not to do so within the time specified, the Paralegal Applicant's application for a P1 licence is dismissed, and written submissions as to costs can be made in writing by the Law Society within 45 days of the receipt of this order.  Any response to such submissions may be made within 55 days of the receipt of this order.
