For the Record: Update on Joseph Groia Appeal before the Superior Court of Justice (Divisional Court)

The following dates provide a summary of Joseph Groia’s appeal from the November 28, 2013 decision of the Law Society Appeal Panel (the Order – see Reasons) and the March 21, 2014 decision of the Appeal Panel (the Costs Order – see Reasons).

As set out below, Mr. Groia’s appeal to the Divisional Court is currently scheduled to be heard on January 8 and 9, 2015.

April 4, 2014: Mr. Groia serves his Notice of Appeal — appealing the entire decision (finding, penalty, and costs).

April 16, 2014: Justice Perell orders, on consent, a stay of the penalty against Mr. Groia, pending the disposition of the appeal or further order of the Court.

April 22, 2014: The Law Society serves its cross-appeal (that the Appeal Division erred in law on the abuse of process issue, and in failing to be deferential with respect to lowering the penalty and reducing the costs).

June 15, 2014: Mr. Groia provides his appeal book, exhibits, transcripts, factum and book of authorities.

July 15, 2014: The Law Society's factum and book of authorities on Mr. Groia's appeal is provided, together with its factum and book of authorities on the cross-appeal.

August 2014: The appeal on the merits before the Divisional Court is set for January 8 and 9, 2015.

August 5, 2014: Mr. Groia's factum and book of authorities on the cross-appeal is provided.

August 18, 2014: The Canadian Civil Liberties' Association seeks leave to intervene.

August 26, 2014: Associate Chief Justice Marrocco orders that Justice Nordheimer will hear any motions for leave to intervene.

August 26, 2014: The Advocates' Society seeks leave to intervene. The parties do not oppose the Canadian Civil Liberties' Association motion for leave to intervene. Justice Nordheimer grants leave to intervene to the Canadian Civil Liberties' Association on conditions. (The order is entered September 2, 2014).

September 2, 2014: Justice Nordheimer hears The Advocates' Society's motion for leave to intervene. The parties do not oppose The Advocate' Society's motion. Justice Nordheimer reserves his decision.

September 8, 2014: The Criminal Lawyers' Association indicates its intent to seek leave to appeal, and files its motion on September 30, 2014.

October 15, 2014: Justice Nordheimer hears the Criminal Lawyers' Association's motion for leave to intervene. The parties do not oppose the Criminal Lawyers' Association's motion. Justice Nordheimer reserves his decision.

October 16, 2014: Justice Nordheimer releases a decision granting The Advocates' Society and the Criminal Lawyers' Association leave to intervene, on conditions.
